Senate Passes Lang Bill Reducing Statute Of Limitations For Contract Actions
COLUMBUS —The Ohio Senate passed Senate Bill 157, sponsored by State Senator George Lang (R-West Chester), which decreases the statute of limitations for contract actions from six years to four years.
"If Ohio wants to compete with other states experiencing economic growth, then we need to ensure our laws are business friendly," said Senator Lang. "By implementing the reforms contained in Senate Bill 157, we can take another huge step in making our state the most business-friendly state in the country."
SB 157 reduces the statute of limitations for brining an action upon a specialty, agreement, contract or promise from six years to four years with the following exceptions:
- An action against the state or a state agency for failure to make any distribution or other payment.
- An action for breach of any sales contract.
- Actions related to commercial paper.
- Actions related to violations to the Consumer Sales Practices Act.
- An action to recover the title to or possession of real property.
The legislation also reduces the statute of limitations for a contract not in writing from four years to two years, unless the action is against the state or a state agency for failure to make any distribution or other payment or an action for breach of any sales contract.
SB 157 has been sent to the Ohio House for further consideration.
