Senate Passes Schaffer Bill Protecting Second Amendment Rights During Emergencies

COLUMBUS—State Senator Tim Schaffer (R-Lancaster) today announced the passage of legislation by the Ohio Senate that would prevent state and local governments from seizing firearms without cause during a state of emergency. "During the COVID-19 pandemic, it became evident that local, state and federal governments have sweeping restrictive powers during a declared emergency," said Schaffer, the primary sponsor of the bill. "Senate Bill 185 does not expand gun rights, but provides an additional layer of protection during an emergency." The concept of this bill originates in Louisiana, when in the aftermath of Hurricane Katrina authorities began confiscating firearms without cause. The Louisiana legislature then enacted a law to prevent the seizure of legally held firearms during a declared emergency. Currently, 24 states have similar laws in place, including Indiana, Kentucky and West Virginia. Senate Bill 185 will now go to the Ohio House of Representatives for consideration.
